Welcome to DGR Distributors (“the Company”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) set out the rules and agreements that apply when you purchase, rent, or use any of our products and services.
By engaging with our business – whether through purchase, rental, servicing, or use of our website – you acknowledge that you have read, understood, and agreed to these Terms. If you do not accept these Terms, you should not proceed with any transaction with us.

3. Definitions
For the purposes of these Terms:
Customer/Client/You – means the person or entity purchasing, hiring, or using our products or services.
Products – means any catering equipment, parts, or accessories supplied by us, whether new or second-hand.
Services – means rentals, repairs, maintenance, installation, consultation, or related services.
Hire Agreement – means any rental or hire of equipment from us, subject to these Terms.
POPIA – refers to the Protection of Personal Information Act 4 of 2013 (South Africa).
4. Products and Services
All products are subject to availability and may be withdrawn at any time.
We make every effort to ensure descriptions, specifications, and pricing are accurate, but errors may occur.
Images and illustrations are for reference only and may not exactly match the delivered product.
Custom orders, modifications, or special requests are produced on a non-cancellable, non-refundable basis unless otherwise agreed.
5. Pricing, Quotes and Payment
All prices are quoted in South African Rand (ZAR).
Prices are subject to change without notice.
Unless otherwise stated, all prices exclude VAT, delivery fees, installation charges, and any additional services.
Full payment is required before delivery or collection, unless a written credit agreement exists.
Quotes are valid for 14 (fourteen) days from issue, unless otherwise stated.
Accepted payment methods include EFT, debit/credit card, and other methods approved by us.
Late payments may incur interest in line with the National Credit Act.
6. Delivery, Collection and Risk
Delivery is offered within South Africa and will be quoted separately.
Delivery timelines are estimates only and delays beyond our control shall not constitute breach of contract.
Risk of loss or damage passes to the customer once goods are delivered or collected.
Customers are responsible for ensuring accurate delivery details and safe access to the premises.
7. Equipment Rentals and Hire
Where equipment is rented from us:
Ownership – All hired equipment remains the property of Sergio Catering Equipment.
Responsibility – Customers are responsible for equipment from the time of delivery/collection until return.
Loss or Damage – Any loss, theft, or damage will be charged to the customer at full replacement or repair cost.
Cleaning – Equipment must be returned in a clean condition. Cleaning fees may apply if returned otherwise.
Late Returns – Additional daily rental fees may apply for late returns.
Deposit – A refundable security deposit may be required and will be withheld in case of loss, damage, or late return.
8. Warranties and Returns
New products are covered by the manufacturer’s warranty only.
Used or second-hand equipment is sold “as is” without warranty unless expressly stated.
Faulty products must be reported in writing within 7 (seven) days of delivery.
Returns will only be accepted if:
o Products are unused, undamaged, and in original packaging.
o Proof of purchase is provided.
Returns are not accepted for:
o Special orders, customised equipment, or used items.
o Products damaged by misuse, negligence, poor maintenance, or unauthorised repairs.
9. Repairs, Maintenance and Installation
All repairs and maintenance carried out by us are subject to availability of parts.
Warranties on repairs cover workmanship only, not misuse or subsequent damage.
Installations must be performed in line with manufacturer guidelines and local safety regulations.
We are not responsible for failures arising from third-party installations or modifications.
10. Limitation of Liability
The Company shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of business, profits, or data.
Our maximum liability in relation to any product or service shall not exceed the original purchase price.
Customers use all products and services at their own risk and are responsible for proper operation, maintenance, and compliance with safety regulations.
11. Customer Obligations
By engaging with us, customers agree to:
Provide accurate and truthful information.
Use products for their intended purpose only.
Comply with safety instructions and guidelines.
Ensure timely payment for all products and services.
12. Intellectual Property
All branding, logos, website content, product descriptions, and marketing materials are the intellectual property of Sergio Catering Equipment.
Customers may not copy, distribute, or reproduce any material without our written consent.
13. Privacy and Data Protection (POPIA Compliance)
We are committed to protecting your privacy in line with the Protection of Personal Information Act (POPIA).
Personal information collected will be used only for processing orders, providing services, and communication.
Customer information will not be sold or shared with unauthorised third parties.
Customers may request access to, correction of, or deletion of their personal information in line with POPIA.
14. Force Majeure
We are not liable for any failure or delay in fulfilling our obligations caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, government restrictions, or supply chain disruptions.
15. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
16. Amendments to Terms
DGR Distributors reserves the right to amend or update these Terms at any time. Updated Terms will be published on our website or communicated to customers and shall take effect immediately unless otherwise stated.
